The present General Conditions constitute the entire agreement between the parties with regard to the online transactions of purchase and sale and provision of services between ISOMED PHARMA, S.L. and its CUSTOMERS.

The CUSTOMER must have the capacity to contract the service and purchase the Products offered on the Website. Thus, only those over 18 years of age with sufficient capacity to contract may purchase Products and contract the services offered on the Website.

3.1. Unless otherwise stipulated in writing, the realization of a purchase from ISOMED PHARMA, S.L. implies the acceptance by the customer of these legal conditions. No additional stipulation made by the customer may differ from those of ISOMED PHARMA, S.L. if it has not been expressly accepted in advance and in writing.

3.2. A purchase is not definitive until it is not accepted by ISOMED PHARMA, S.L.

4. Purchase process

The responsible for the transactions is ISOMED PHARMA, S.L. The data you enter on this website is encrypted thanks to our Secure Socket Layer (SSL) certificate. If you are not viewing this website securely, we recommend that you do not proceed with the payment.

These are the steps you will follow in the purchase process:

1. Product selection: on the website the CUSTOMER may choose the desired product(s). All products are accompanied by a description and indication of use, along with instructions for use and price. In the case of diagnostic products, instructions for test preparation and a video tutorial on how to perform the test are also provided. If the CUSTOMER decides to buy it, in that same screen he/she must select the option "Buy". The products selected by the CUSTOMER will be added to the shopping cart.
2. Shopping cart: once the CUSTOMER has completed the selection process, he/she must "click" on the shopping cart symbol that will appear at all times in the TOP BAR (upper right corner of the website) to continue the process. You will then be presented with a form to calculate the shipping costs of the products, and in the case of diagnostic kits, also the costs of collection from your home. To the right of the form you will find the options "Update cart", with the total price to be paid, and "Checkout".

4. Shopping cart summary: in the following screen a summary of the shopping cart will appear with the name of the Product, quantity, price of the product, shipping costs, if applicable, and total price. At this moment the CLIENT will be able to "Confirm the order". Before, he/she must have clicked on the acceptance box of these General Conditions and the Privacy Policy for the treatment of the data provided to ISOMED PHARMA, S.L.
5. Payment by card: a summary of the order will appear and the CUSTOMER may continue with the purchase process by selecting the button "Pay by card" or "Cancel order". The CUSTOMER must fill in the necessary data for the payment (card number, expiration date, security code, etc.) and select the "Pay" button.
6. Confirmation: If no error has occurred during the process, an order confirmation screen will appear. You will also be sent an email confirming your registration and the order with the details of the purchase. 8. Confirmation of receipt of samples: in the case of diagnostic kits, you will receive an email when we receive the kit with your breath samples for analysis at the Laboratory of Analysis of ISOMED PHARMA, S.L.
9. Availability of results: as soon as your samples have been analyzed and you can see the results, you will receive a confirmation e-mail.

5. Pricing

5.1. The prices published on the website of ISOMED PHARMA, S.L. are exclusive for online purchase through the portal. These prices cannot be applied to any other form of purchase.

5.2. Published prices include taxes, administrative expenses and shipping costs (and collection in the case of in vitro diagnostic kits) for the Peninsula and Balearic Islands, and are valid except for typographical errors. The published discounts will remain valid until they are changed or eliminated.

5.3. Shipping costs for the Canary Islands, Ceuta and Melilla are calculated during the purchase process and will appear in your order summary and included in the total price, before confirming the completion of your order.

6. Terms of payment

6.1. Products and services shall be paid in advance by credit card or bank transfer.

7. Shipping

7.1. ISOMED PHARMA, S.L. will not ship any product until the Accounting Department has verified that payment has been irrevocably made.

7.2. Delivery shall be deemed to have been made when the carrier has placed the products at the disposal of the customer and the customer has signed the delivery receipt document. It is the customer's responsibility to check the products upon receipt and to state all reservations and claims that may be justified in the delivery receipt document.

7.3. ISOMED PHARMA, S.L. isomed pharma, s.l. hereby states that the delivery times indicated are approximate and focuses its efforts on respecting them. A delay will not imply the cancellation of the purchase or any compensation. Any penalty clause for delay incorporated by the customer in your purchase is void by the application of point 3.1 of these General Conditions.

4.4. ISOMED PHARMA, S.L. will send the products by the courier service indicated in the order confirmation email.

4.5. Any charges for customs duties and/or local taxes shall be paid by the customer at the time of placing the order, when confirming the shopping cart.

4.6. ISOMED PHARMA, S.L. reserves the right to make partial deliveries of one or more products, without any extra cost to the customer.

8. Returns

8.1. ISOMED PHARMA, S.L. will accept the return of the products delivered to the CUSTOMER, except in the case of medical devices, which will be regulated by section 8.4, within a maximum period of 7 calendar days after the date of delivery to the CUSTOMER's address.

8.2. ISOMED PHARMA, S.L. will not accept returns if the products are not in perfect condition and in their original packaging. The original packaging must be repacked so that they are received in perfect condition, being prohibited the use of seals and adhesive tapes on them.

8.3. Due to their special characteristics, ISOMED PHARMA, S.L. will not accept returns of the following products: consumables, easily reproducible products (e.g. software), non-standard products and customized products.

8.4. According to article 12 of RD 870/2013, of November 8, which regulates the distance sale to the public, through websites, of medical devices for human use not subject to medical prescription: no returns of medical devices may be accepted once they have been shipped and/or delivered to the CUSTOMER, except for those that have been supplied by error of ISOMED PHARMA, S.L.The return of medical devices will not be accepted once they have been shipped and/or delivered to the CUSTOMER, except for those that have been delivered by mistake, do not correspond to the order or have been damaged during transport. In all cases, the returned medical devices will be destined for destruction, through the integrated waste management systems protocolized in our internal procedures.

8.5. To exercise the right of return, the CUSTOMER should contact ISOMED PHARMA, S.L. through the e-mail pedidos@isomed.com or by calling 913440655, indicating:

- Order number, full name and date of order.

- Products to be returned.

- Telephone number and contact person.

8.6. The CUSTOMER shall return the products to the address specified by the CLIENT. ISOMED PHARMA, S.L. The return transport costs will be borne by the CUSTOMER except in the cases specified in paragraph 8.3, in which the CUSTOMER will be responsible for the costs. ISOMED PHARMA, S.L. the CUSTOMER shall bear the costs.

8.7. Once the lot, expiration date and the correct condition of the products have been checked, ISOMED PHARMA, S.L. will proceed to issue a credit note and the refund of the amount. If the transport agency returns a shipment to us because the maximum number of days that the package can be retained at the destination agency since the order leaves our facilities without having been delivered or picked up or because the recipient does not accept the shipment despite having been initially paid, the amount of the products in the order will not be refunded.

Those orders in which the CUSTOMER enters a wrong postal code, as this is the reference data when generating a shipping number with a specific destination franchise, and it is necessary to re-dispatch it to another franchise, the extra charge for this service will be the responsibility of the customer and not of the agency. 9. Warranties

All the products commercialized by ISOMED PHARMA, S.L. are guaranteed, under the legally established terms, until the expiration date printed on the primary and/or secondary packaging, with the exception of those to be used for professional purposes. These products intended for professional use are subject to the warranties established by the manufacturers, normally between six and twelve months. After 14 days from the date of purchase, any claim on accessories may not be considered under warranty.

9.2. The warranty of the products shall be invalidated by any of the following circumstances:
